Terms of Service

These Terms of Service ("Terms") govern access to and use of the Notes EHR and practice management platform ("the Platform," "Notes"). By creating an account or using the Platform, a practice agrees to these Terms.

1. Eligibility & account use

Notes is intended for use by licensed behavioral health practices and their authorized staff. Accounts are provisioned per practice, with role-based access assigned to providers, administrators, and billing staff.

2. Clinical responsibility

Notes provides software tools to support scheduling, documentation, billing, and communication. The practice and its licensed providers remain solely responsible for clinical judgment, the accuracy of clinical documentation, and compliance with applicable licensing board and payer requirements — including review and approval of any AI-assisted content, such as TherapyFuel drafts, before it is finalized in the record.

3. Subscription, billing & cancellation

Plans are billed per provider on a monthly or annual basis as selected at signup. Practices may cancel at any time; access continues through the end of the current billing period. Fees are non-refundable except as required by law.

4. Data ownership & export

Practices retain ownership of all clinical, scheduling, and billing data entered into the Platform. Data may be exported at any time during an active subscription and for a reasonable period following cancellation.

5. Acceptable use

The Platform may not be used to store or process information for anyone other than the practice's own clients, or in any way that violates HIPAA, applicable state law, or professional licensing requirements.

6. Service availability

We aim for high platform availability and will provide reasonable notice of planned maintenance. Notes is not liable for interruptions caused by factors outside our reasonable control.

7. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to account administrators in advance of taking effect.
